
A 65-year-old woman with a 70% disability has sparked widespread concern among pensioners in Spain after losing her contributory retirement pension. The Superior Court of Justice of Extremadura upheld the denial of her benefits because she failed to renew her registration as a jobseeker with the SEXPE for more than two years, from September 2021 until she applied for retirement.

The affected woman suffers from osteoarthritis and morbid obesity, which left her dependent on a wheelchair. In court, she argued that her health prevented her from visiting the public employment service to renew her registration, but she did not provide sufficient evidence to justify the gap.
Spanish Social Security requires claimants to be registered as active jobseekers to generate the necessary contribution period for unemployment benefits. The interruption of more than two years broke the continuity required for the pension. Without adequate proof, the court ruled against her.

Failure to meet this requirement can lead to temporary suspension of non-contributory pensions. This case highlights a common scenario for people receiving subsidies after age 52. At 65, those subsidies automatically convert into a retirement pension if all conditions are met. However, if the jobseeker registration is not renewed, SEPE (the State Public Employment Service) suspends the subsidy. Without recent contributions, the pension is inaccessible.
In this instance, the so-called “parenthesis doctrine” – which can excuse periods of illness – did not apply due to lack of evidence.
This decision serves as a stark reminder of the importance of administrative formalities for disabled retirees. While non-contributory disability pensions of over 65% last until age 65 and then transition to non-contributory retirement (subject to income limits of €7,905.80 per year in 2025), this case involved a contributory pension linked to unemployment benefits.
SEPE has warned that similar oversights can trigger automatic suspensions. All disabled people on unemployment subsidies are advised to check their registration periodically, as the system automatically detects inactivity.
